SALE TERMS AND CONDITIONS

Please READ and FAMILIARIZE yourself with the TERMS and CONDITIONS of this sale.

You will be bound by these Terms and Conditions whether you read them or not!

Oregon State University, its associates and the auctioneers’ function is to bring the buyer and the seller together.

 

1.   PERSONAL CHECKS ARE ACCEPTED FOR PAYMENT.  ANYONE WITH ACCOUNT PROBLEMS WITH OREGON STATE UNIVERSITY IN THE PAST WILL BE REQUIRED TO PAY FOR THEIR HORSES IN CASH.

2.   Driver’s license and Social Security Number will be required to write a personal check.  Payment terms for this sale are cash.  Payment in full must be made to the cashier immediately after the sale.  All payments shall be in U.S. currency and on U.S. banks only.  Method of payment shall be Cash, Cashier’s Check, Traveler’s Checks, Personal Checks or approved Bank Check which has been verified and approved in advance by cashier and/or officers of Oregon State University.  All payments must be made to Oregon State University.  All “returned” or insufficient fund checks will be immediately turned over to the District Attorney and charges will be filed.

3.   THERE ARE NO EXPRESSED OR IMPLIED WARRANTIES MADE BY AUCTIONEER OR OREGON STATE UNIVERSITY AS TO THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF ANY ANIMAL FOR SALE.

4.   The highest bidder is to be buyer.  If any dispute arises between or among two or more bidders, sole authority to settle the dispute as he sees fit is reserved by the auctioneer and the decisions shall be final.  Seller reserves the right to waive the sale of horse BEFORE it leaves the ring.  The auctioneer reserves the right to reject any or all bids.          

5.   The Sales Management and/or Auctioneer is not responsible for the integrity of any specific bid and the seller understands and assumes all responsibility for any bid that is made and not thereafter honored.

6.   Every effort has been made to insure correctness of this catalog and, in most cases, information quoted concerning the horses is taken from the official AQHA records.  Announcements in the ring take precedence over printed information.

7.   All horses are sold AS IS with no expressed and/or implied warrantees and/or guarantees.  Make sure to pre-inspect horses prior to purchasing.

8.   Title to and risk of loss passes to the buyer when the animal is knocked off as sold by the auctioneer.  Immediately after the horse is sold, it will be the sole risk and responsibility of the buyer.  Effective from the time of purchase, the buyer assumes responsibility for the maintenance and care of the animal.  The buyer further agrees to indemnity and holds the consignor and Oregon State University harmless from all loss, cost and expense arising from illness, injury or death of such animal, or loss or damage to property, and injury or death of persons, caused by the buyer, buyer’s agents or employees, or by the animal, subsequent to the time of purchase.  NO HORSE WILL LEAVE UNTIL FINAL SETTLEMENT HAS BEEN MADE.

9.   When a horse is sold, the buyer shall sign the Acknowledgment of Purchase which will be brought to him/her.  Title passes when the buyer signs this Acknowledgment.  Name and address MUST BE LEGIBLE and complete and MUST BE FILLED IN EACH TIME A HORSE IS BOUGHT.  This acknowledgment is to be filled out exactly as the purchaser wants it registered.  We will not be responsible for errors on transfer, if the acknowledgment is not properly and clearly filled out.

10. All registration papers will be withheld until checks clear the bank.  At 30 days from the date of the sale, the registration papers, along with transfer certificates, will be mailed directly to breed registry for transfer of ownership to the new buyer.

11. Buyer is responsible for the registration papers transfer fee and any applicable breed association membership fees.

12. Buyers and spectators are cautioned to be careful while on the grounds, particularly while horses are being shown or sold in the sale ring.  All persons attending the sale do so at their own risk.  Neither the owners nor Oregon State University and its employees assume any liability, legal or otherwise, for accidents to persons or property, before, during, or after the sale.            

13.  Buyers it is your responsibility to know the health and brand requirements for your state.
